Click here for link to news item. ***** 18th April, 2011: The police visited the society yesterday, i.e, on 17th April, to nab the former Hon'rary Secretary of the society Mr. Kuldeep Singh Virk in a case regarding handing over illegal possession of flats in contempt of the orders of High Court. However, Mr. Kuldeep Singh Virk managed to escape from the society. The news was carried by 'The Tribune' today. Meanwhile some members also filed a contempt petition regarding illegal occupancy of flats in the society. ***** 24th February, 2011: Another message has been received from the petitioners. The same is reproduced below : Dear Members! Our society has become a typical example of how the corrupt and culprit politicians and goonda elements use and misuse the sentiments of people to derail the process of justice and get away with their fraudulent acts and ghastly intentions. It is strange that many members, who were patient enough, that they silently waited for 10 long years to get their flats and never even raised a little finger towards the open loot, brazen corruption, nepotism & frauds committed by the office bearers of the society, have suddenly decided not to wait even for another few months to get the flats in a legal and just manner. They must think by themselves as to who used them and for what purpose ? However, despite our repeated requests, these people have dragged us into another bout of litigation, which we never wanted to initiate. They have not only delayed the matter which was coming to its logical conclusion but have also put their feet on the axe of law and may have to face severe consequences. However there is again a silver lining to this dark cloud, that in case those members who have taken possessions of flats in contempt of court had to face the axe of law, all others from all categories will get the allotments. We again wish to reiterate that we are just fighting to bring truth and justice to the society. It's time that we must all think what fruits do we want to reap and then sow the seeds accordingly. The seeds of injustice, hatred, nepotism and goondaism can never bear the fruits of peaceful living in the society. The members of this society have to decide the fate of the society and that of our children and families who have to live there for years to come or else we shall continue to be looted, used and misused by goondas and mafias for their own vested interests. ***** 11th November, 2010: An urgent meeting of the members of United Action Front Society shall be held on 14.11.2010 (Sunday) at 11:00 AM (Sharp) at Fragrance Garden, Sector 36, Chandigarh. Anyone out of 285 genuine members list, who wishes to become a member of United Action Front Society may also join. Non-members please excuse. ***** 26th October, 2010: The matter of illegal trespassing of flats by some members in connivance with some corrupt managing committee members of the society was raised in the High Court today. The court directed the counsel of society to get the flats vacated immediately or else stern action shall be taken against all involved. Meanwhile, the Assistant Registrar, Mohali vide his letter dated 06.10.10 instructed the Inspector, Cooperative, Mohali that the managing committee members of the society be directed not to give any allotment or possession of flats to any member of the society. The same is reproduced below : "This is in continuation to our earlier request dated 7th August, posted on this website. However despite our request, some members have intruded into the flats of society in contempt of the orders of High Court. We again wish to reiterate that we are fighting to bring truth and justice to the society, which was being mercilessly looted and embezzled by the corrupt managing committee members. All members of the society have borne the brunt of this corruption and embezzlement and we the petitioners are the worst sufferers of the same. We have no intention to act against any individual member of the society, as all of us have already suffered a lot at the hands of these corrupt persons. That's the reason we have restrained ourselves from taking anydecisive step against the members who have intruded into the flats of society in contempt of the Court. It is also reiterated that the committee constituted by the Hon'ble High Court has been assigned the task to re-allot the flats to all eligible members of the society, which is expected to be completed by December 2010. We therefore humbly request the members who have intruded into the flats to vacate the flats until the new flat is allotted to them by the committee. In case however, the members decide to go against the law, then they shall be responsible for the loss that they may have to bear as the petitioners shall be left with no other option but to take some decisive action against them." ***** 6th October, 2010: Some members have informed that the committee constituted by High Court today visited the society. They reportedly also held some deliberations with the officials of Cooperative Department. Some members have also informed that the committee has decided to seek time upto December 2010 from the Hon'ble High Court to complete their assigned work. ***** 6th September, 2010: The Hon'ble High Court issued an order vide which a committee has been constituted to look into the matter. Click here for link to a local Punjabi newspaper of Mohali Sky Hawk. ***** 21st August, 2010: On the complaint filed by the members of United Action Front against the illegal trespassing of flats by some members in the society, the Registrar, Cooperative Societies, enquired into the matter and recommended an FIR to be lodged against the President, Hon'rary Secretary and those members who have forcibly intruded into the flats of society. Click here to see the copy of order. ***** 19th August, 2010: A news item was carried in the Chandigarh Newsline today stating that the arbitrator appointed by High Court in land resumption case has waived off 75% penal interest, which was payable to GMADA. Still we have ended up paying about Rs 5 Crores towards interest, penalty and penal interest to GMADA. But let's hope that the society shall now be saved atleast from the axe of GMADA. The President has been requested to supply the copy of an order issued by the Arbitrator for information of the members and shall be uploaded on site as and when available. Click here to see the news item carried by the newspaper. ***** 10th August, 2010: An in-principal decision was taken by the Court to constitute a high level committee to handle this entire issue. An order to this effect shall be issued by the High Court soon. ***** 7th August, 2010: We have received a message from petitioners for the members of society. The same is reproduced below: "It has come to our notice that the corrupt president and secretary of the society are misguiding and instigating some members to intrude into the flats of society in contempt of the orders of High Court. We wish to inform the members that High Court has already issued detailed directions to the Administrator to re-allot flats to all 285 & 109 genuine members of the society through a fair process of law. The corrupt president and secretary however did not cooperate with the administrator because of their own vested interests, which delayed the matter further. Now these people are instigating are trying to use some members as scapegoats to further complicate the matter and adjust their own persons to whom they have sold the flats to pocket the illegal premium and who are likely to be ousted if the orders of High Court are implemented. We all know that the management of the society has committed large scale frauds because of which various members of the society had been approaching the courts at different times and the members of the society have suffered. The petitioners and many other genuine members of the society have not been given any allotments of flats and the flats still continue to be sold in the market to pocket the premium. We are only fighting to protect the legitimate rights of genuine members and bring truth and justice to the society. We have no intention to act against any individual member, as all of us have already suffered a lot at the hands of these corrupt and cruel persons, who had been misguiding and using us for their own vested interests. However, at the same time we are determined to protect our rights at all costs. Any member intruding into the flats in contempt of court shall be liable to loose his membership in the society as per the provisions of law. Besides, the member shall also be liable to be prosecuted, for committing contempt of court. Even if the member is able to forcefully keep the possession of flat for some time, he may eventually loose his flat and membership for all times to come. We have all borne the cost of voting corrupt managing committee members to power, but the dawn is not far, if we all unite for truth and justice. The High Court has already issued detailed orders and all 285 & 109 members shall be allotted flats by the court soon. We therefore humbly request all members of the society not to be misguided by the corrupt persons and do not act in contempt of court. It may also be noted that the court has already threatened to dissolve the society and return its land to GMADA. We request all members to cooperate in our quest for truth and justice lest we are all set to loose everything. " ***** 6th August, 2010: The Deputy Registrar, Ropar vide his order dated 06.08.2010 stayed the operation of resolution vide which Mr. Kuldeep Singh Virk was appointed as Hon'rary Secretary by his president wife Mrs. Lovleen Bhupinder Kaur. He will not interfere in any work of the society till further orders. Click here to see the copy of order. ***** 30th July, 2010: In view of the fact that the society continues to perpetrate the illegal activities despite clear orders already issued by the High court., the Court today threatened to dissolve the society and return the land of society to GMADA to be auctioned. The petitioners requested that the control of the society may be given to an independent agency such as CBI to implement the orders issued by High Court. The matter shall be adjudicated on the next date. Next date of hearing is 10th Aug, 2010. ***** 17th July, 2010: In response to the order of High Court dated 30.06.2010, the society submitted its reply in High Court along with the details of 285 genuine members and copy of the approved construction plan. The members of NGO may contact any of the fellow members listed in the para below to verify their details and report the discrepancies, if any, immediately. ***** 11th July, 2010: Meeting of 285 Genuine Members of the society was held with an overwhelming response. Members of the society held free and detailed discussions on the current happenings. Some members informed that illegal possession of some flats are being handed over by the society to some members in contempt of the orders of High Court. The objections raised by the president of society and other managing committee members on the list of 285 genuine members in their affidavits submitted in the High Court were also discussed. The issue of fraudulently showing deficient payments of various members in the details submitted by society in the High Court was also discussed besides several members pointed out various activities of corruption, nepotism and frauds in the society. In view of the circumstances, it was felt that there is an urgent need for all 285 Genuine members to present their cases in the High Court to safeguard their interests from such frivolous objections & acts of corruption & fraud. In order to take up the issue in a consolidated manner for speedy justice to all genuine members, it was suggested that all 285 genuine members should launch a joint forum. In this regard it was decided to float a legally constituted non-political, no-profit organization such as an NGO. It was therefore unanimously decided to get an NGO registered and all members present in the meeting became members of the NGO. Those genuine members who could not attend the meeting are also requested to get in touch with any of the members listed below to become members of NGO. It was also brought to the notice of house that the information present on this site, particularly lists of members etc, are being misused by some unscrupulous elements to raise frivolous objections against genuine members. It was therefore decided to restrict access to lists only to the members of NGO and unload the lists from site. However in order to prevent the members from being misguided, all other relevant information regarding the society shall continue to be posted on this website. Members are requested to attend the meeting. Members are again requested to intimate their details at phone numbers or e-mail address given in the paragraph below. ***** 2nd July, 2010: It has been observed that many aggrieved members are still approaching High Court to safeguard their interests against the corrupt and fraudulent activities of the society. Further, despite intervention of High Court the society continues to manipulate the records and defraud genuine members through various illegal means. Questions are also being raised on the validity of the list of 285 genuine members and fraudulent transfer of memberships from amongst 285 list. Under the scenario, it is evident that the legal battle may not be over soon and some further actions may have to be taken by the genuine members to safeguard their interests. Also multiple petitions being filed by various members are leading to time delay as well wastage of time and money of the members, who are approaching the court for same cause. In order to chalk out further line of action, and unite all like minded members of the society who are interested in quick and just resolution of the issue and quick implementation of the orders of High Court dated 12.01.2010, the members who have approached the High Court in various writ petitions have decided to hold a meeting of all 285 genuine members on 11th July, 2010 (Sunday). The time and venue shall be intimated shortly. In orders to address the grievances of all genuine members in a consolidated manner and also to keep all members apprised of the latest developments through e-mail & SMS etc., it has been decided to constitute a closed group of members. The members of the new Managing Committee under the presidentship of Mr. Baldev Singh Mangat also submitted their objections on the report of administrator and on the lists of members submitted by Mrs. Lovleen Bhupinder Kaur in the court with her affidavit on 23.04.2010. The revised plan submitted by the society in GMADA has been obtained under RTI. As per the revised plan the size of flats in all blocks except the first four blocks (already in possession) have been reduced in size by over 150 sq. ft. each. The comparison of dimensions of the Bedrooms, Drawing Dining, Kitchen etc in the first block viz a viz other blocks as per the plans submitted by the society in GMADA are as under: Approved Plan Revised Plan 1st Bed Room 14'-4.5" x 11.0' 14' x 10'-6" 2nd Bed Room 13' x 10' 12'-9" x 10' Drawing Room 13' - 3" x 12' - 7.5" 13' x 12' - 1.5" Dining Room 11' - 3" x 13' - 4.5" 11' x 13' - 4.5" Kitchen 11' x 7'-9" 10' - 10.5" x 7' x 6" The area of other places such as Toilets, Verandahs etc., has also been reduced. The members are hereby warned that the data being shown to them or displayed in the society is neither audited nor authenticated by any authority and many serious mistakes and manipulations have been reported in the data. It is also brought to the notice of members that the data being shown to them can be entirely different from the one that the president has actually submitted to the administrator and has been cooked up to mislead the members in order to garner their support and get their signatures. Under the circumstances members are advised to use their own wisdom before signing any document which may ultimately be used against them by the unscrupulous & mischievous elements of the society. We are trying our level best to keep the members informed through whatever authenticated information we can obtain. The Hon'ble Court directed that the petitioners shall give a written request to the President of the society and on payment of charges to be determined the president shall provide a copy of the record to the members of the society. During the arguments the counsel for the society made a statement vide which the society agreed to allot flats to those Genuine Members who have deposited Rs 2.35 Lacs each in pursuance of the demand notices issued by the society on 09.09.2004 and have subsequently deposited Rs 7.90 Lacs. ***** 25th Nov, 2009: Next date of hearing is 14th Dec, 2009. ***** 20th Nov, 2009: The society submitted an affidavit in the court. As per the affidavit following flats have been reserved for petitioners. Flat Nos 177, 178, 189, 190, 191, 192, 283, 303, 307, 316, 317, 318, 319, 320, 321, 333, 334, 342, 345, 346, 352, 358, 371, 378, 381, 382, 384, 410, 411, 420, 421, 422, 423, 424, 425, 436, 437 (Total 37 Flats). If any other member of the society has been issued any allocation or allotment letter in respect of any of these flats and wants to maintain his rights or interests in the flat, he/she may immediately send his complete address, contact number and scanned copy of membership certificate and allotment/allocation letter through E-mail at unitedcoop@gmail.com, so that the flat could be got deleted from the list. This is being done to prevent any fraud with any member who might have been given allocation/allotment of these flats by the society. The matter is likely to be decided on the next date of hearing i.e., on 25.11.2009. ***** 19th Nov, 2009: ***** GOOD NEWS ***** The society today offered to reserve flats for all the petitioner members who have approached Hon'ble High Court in various writ petitions till date. Following this High Court today ordered the society to reserve flats for all the petitioners and submit an affidavit in this regard on 20.11.2009. The court further ordered the petitioners to physically verify the flats in the society to their satisfaction. The copy of the order is still awaited. It seems that the legal battle may soon come to some conclusive end with all the petitioners getting the flats. Next date of hearing is 25.11.2009. ***** 14th Sep, 2008: We want to request all the members to send us the details of the documents they possess i.e.. Name of the member, Share certificate no& date, father's/husband's name, address, telephone no, payment receipts (with complete details...Cash/cheque/DD no., bank name, amount, Receipt no and date) allotment date, flat allotted/not allotted at our e-mail as we are now preparing the data so that the same is displayed on the web site. This is being done as in many cases same flat is being allotted to more than one person. This list is being made on the request of a large number of members by some respected members of the society and its compilation will be made public on this web site soon. Format of the same is this ***** 26th Aug, 2008: Today, in the court a CM was filed by four members of the society. Their plea is for making these members as party in the case and they also want the stay on possession to be vacated. Notice has been given for 30th of Sep 2008. ***** 18th Aug 2008: GMADA has returned the payment of Rs 50 Lakh which was given to them by the society recently on the plea that the land of society is under resumption and no payment will be accepted. It may recalled that Mr. Swaran Singh has collected the land cost of Rs 2.35 Lacs each from over 400 members of the society till March 2005, which amounts to over Rs 9.40 Crores. However, the society still owes to GMADA over Rs One crore out of the total principal installments of Rs 7.93 Crores. Besides this, GMADA has imposed penalty and interest of over Rs 5 crores on the society due to non-payment of dues, which is also outstanding. The account statement upto March 2006, is already available on site at 9th July, 2007. The figures would speak that even after paying the due land cost, every member will have to shell out over Rs 2 Lacs each to clear these dues on account of the frauds done by our elected president and his associates. ***** 13th to 15th June 2008: An Akhand Path was organised in the premises of the society. Bhog and langar was organised on 15th June 2008. To our utter surprise, Sh. Swaranjit Singh, Addl Registrar, Coop Societies, Punjab was invited and was duly honored and given saropa, for the reasons best known to society. ***** 06th June 2008: Mr. Tarlochan Singh, member executive committee who was having the charge of treasurer, resigned from the post. As per his resignation letter the account books were never shown/handed over to him ever and even he was barred from getting bank statement from the society's bank. The next hearing is on 26.08.2008. ***** 17th March 2008: The lawyer of Society demanded adjournment till next date as he was not well. Further, PUDA and RCS demanded some more time for filing their replies. The next hearing is on 14.05.2008. In the meantime, the RCS has notified some major changes in the bye-laws of Cooperative House Building Societies keeping in view the misappropriations and frauds done by the president of UCHBS and some other such ill-famed societies in Punjab. The next hearing is on 17.03.2008. ***** 10th Jan, 2008: The Society submitted its reply. The other respondents viz PUDA, RCS etc. were also directed to file their replies by next hearing. The next hearing is on 04.02.2008. ***** 26th Nov, 2007: The society did not file the reply to the petitions inspite of the orders of Hon'ble High Court on the pretext that they have not received copies of the petitions. The lawyer of the society requested for more time to file the reply. The court ordered them to file the reply 2 weeks before the next hearing. The next hearing is on 10.01.2008. ***** 25th Sept, 2007: Today was the hearing of Civil Writ Petition No 7742 of 2007 filed by some members in the Hon'ble High Court. Surprisingly, the court was flooded with the presence of aggrieved members and their lawyers with another about 25 members approaching the court through three different petitions. These petitions were also heard with the original petition. Further, another two lawyers appeared before the Hon'ble Court and requested for time to file their petitions as their clients are also the aggrieved parties. The Hon'ble High Court viewed the matter very seriously and while issuing notice of motion to the three new petitions asked the society to file the reply to original petition within 4 weeks. Other lawyers have also been asked to file their petitions before the next date so that the petitions of all aggrieved members could be heard together in the interest of justice. The next hearing would be on 26.11.2007. ***** 9th July, 2007: As per the latest Account Statement obtained from GMADA, the society has total dues of Rs 4.88 Crores to be paid to GMADA on account of land cost. This includes 3.90 Crores on account of penalty and Rs 98 Lacs towards balance principal amount of land cost. Click here to see the orders. ***** 15th May, 2007: The Secretary, Housing & Urban Development, Punjab vide his orders dated 17.04.2007 dismissed the Revision Petition filed by the Society against the orders of Estate Officer, PUDA, Mohali ordering resumption of site allotted to the Society due to non-payment of land cost to PUDA. The Secretary observed that the Society is merely adopting dilatory tactics to evade the payment of dues to GMADA (previously PUDA). Click here to see the orders. ***** 26th March, 2007: After repeated requests, the Secretary Cooperation, Mr. B. S. Sudan announced the orders on 19th March, 2007. The Secretary has also pointed out serious irregularities and violation of law by the managing committee in allotment of flats. He has also noted that the managing committee wants to conceal the facts by not submitting any record. But finally the case was remanded back to DRCS (Legal) for passing fresh orders after hearing the parties within 2 months. Click here to see the orders. The Hon'ble Minister ordered an enquiry into the matter by a senior officer and directed the department to submit its report within one month. Sudan heard the arguments of lawyers in the case Sanjoo Pandita vs Others. After 90 minutes of arguments, the Hon'ble Judge reserved the judgment. During the arguments, the president of the society Mr. Swaran Singh said that the allotments have been given systematically on first come first served basis and to those members who deposited Rs. 2.35 Lacs (Land Cost) with the society. However when some aggrieved members stated this to be false, the president admitted that the formula holds good for 90% cases while the rest 10% is hotchpotch. He further said that the first member who deposited the money was given ground floor, followed by next member given 1st floor....and so on. We hope that this statement gets a notice of the judge. ***** 11th Feb, 2007: The President, Mr. Swaran Singh has stated that flats would be provided to members who had deposited their money by February 2005. He further stated that a revised plan of 418 flats has been submitted by the management committee to the Punjab Urban Development Authority (PUDA). It may however be noted that the President did not mention the amount of deposit that will define the criteria for allotment of flat. Further, no resolution has been passed in the society to increase the number of flats to 418 and also no revised plan of 418 flats has been tabled in any meeting of the managing committee. Click here to read the complete story. ***** 10th Feb, 2007: Registrar Coop Societies, Punjab, Mr. Vishwajit Khanna, in a statement given to Chandigarh Newsline said that “The United Cooperative House Building Society, Mohali is the most ill-famed society out of 21000 registered housing societies in Punjab. You name the irregularity, bungling and financial misappropriation – it’s all there”.
